Breaking: Court Rules Out DSS Suit To Keep Emefiele In Detention


The Federal High Court in Abuja, Thursday dismissed suit filed by the Department of State Services (DSS) to keep the suspended Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele in detention.

It was gathered that the DSS on Wednesday secretly filed a suit to keep Emefiele for 14 days in its custody.

This comes after a Federal High Court in Lagos, granted a bail application submitted Emefiele’s legal team, despite the bail being granted, the DSS re-arrested the apex bank Chief.

But the presiding judge, Justice Hamza Muazu who opposed the suit said that it was an abuse of court process and identifying the lack of jurisdiction.

Upon questioning by the judge about the court’s jurisdiction, given the exclusive rights of the Magistrate Court to grant detention orders under Sections 293 and 296 of the Administration of Criminal Justice Act, the DSS’s counsel, Mr. Victor Ejelonu, opted to withdraw the matter.
