Court Demands Yahaya Bello’s Appearance Over 80 Billion Naira Fraud Allegations

Justice Emeka Nwite of the Federal High Court, Abuja, has reiterated the necessity for former Governor Yahaya Bello of Kogi State to appear in court and respond to the fraud allegations leveled against him by the EFCC, amounting to 80 billion naira.

In a ruling on April 23, the court directed the EFCC to serve Bello with the money laundering charges via his legal representative. Justice Nwite upheld the antigraft agency’s application, emphasizing that no application should proceed without the defendant’s presence in court.

Citing section 396(2) of the Administration of Criminal Justice Act 2015, the trial judge emphasized that Yahaya Bello must first make himself available before filing any legal processes. Given Bello’s repeated defiance of court orders, the judge ruled that he would not be permitted to submit any applications or be granted a hearing. The judge further noted that even if an arrest warrant was obtained unlawfully, Bello should have appeared in court.

Additionally, Bello sought to delay further proceedings in the alleged money laundering case until the Court of Appeal ruled on a related matter.

Represented by his counsel, Abdulwahab Mohammed, Bello informed the court of the EFCC’s motion ex parte, which secured an order from the Appeal Court to halt the contempt proceedings against the agency at the High Court in Lokoja.

Mohammed argued that awaiting the outcome of the appellate court’s decision, scheduled for May 20, before proceeding with the trial in the Federal High Court, would be prudent.
