Edison Ehie Takes On Rivers Assembly for Disregarding Fubara’s Authority

At a plenary session on Friday, Edison Ehie, the Chief of Staff to Governor Siminalayi Fubara of Rivers State, challenged the State House of Assembly’s decision to pass into law the repealed House of Assembly Service Commission Bill, thereby overriding the governor’s authority.

The law as repealed took away the power to appoint the chairman and members of the State House of Assembly Service Commission from the governor and vested it in the Assembly.

Ehie, who was previously a contender for the Speakership of the House, emphasized that the State House of Assembly lacks the constitutional authority to enact such legislation.

He argued that the provision in the Rivers State House of Assembly Service Commission (Amendment) Law, 2024, contradicts the 1999 Constitution, rendering it legally invalid.

In a pieces titled “Can the Rivers State House of Assembly remove the power of the governor to appoint the chairman and members of the Rivers State House of Assembly Service Commission and transfer it to the house?” released on Saturday in Port Harcourt.

Moreso,Ehie, a seasoned lawyer and former deputy speaker, underscored the constitutional power vested in the governor by Section 5(2) to make appointments to various executive bodies.Thus, the House of Assembly does not have the authority to make such appointments

However,According to Fubara, the role of the Rivers State House of Assembly concludes upon confirming appointees, as outlined in Section 198 of the 1999 Constitution, which grants the Governor the authority to appoint individuals to various executive bodies.
